Terms, written
to be read.
Acceptance
Using carga.run or the CARGA iOS app means you accept these terms and the Privacy Policy. If you do not accept them, do not use CARGA.
Eligibility
CARGA is for people 13 and older. By using it, you confirm you are at least 13.
Estimates, not medical advice
CARGA PROVIDES FUELING ESTIMATES FOR GENERAL WELLNESS. IT IS NOT MEDICAL ADVICE.
CARGA does not diagnose, treat, cure, or prevent any condition, and its numbers are not a prescription. They are estimates, labeled as estimates, on every surface that shows them. For medical concerns — including any decision about eating or training with a health condition — consult a qualified professional. Nothing in CARGA replaces that judgment.
License
Brandon Alvarez, doing business as CARGA, grants you a personal, non-exclusive, non-transferable, revocable license to use the CARGA app on Apple devices you own or control, for your own training. This is a license, not a sale. Except where the law forbids the restriction, do not copy, modify, distribute, rent, sell, or reverse-engineer the app or any part of it. You can end this license at any time by deleting the app; we can end it if you break these terms.
Acceptable use
Use CARGA for what it is — fueling guidance for your own training. Do not:
- probe, overload, or disrupt the service, or route around its limits;
- scrape or harvest this site or its content;
- resell CARGA or present its estimates as medical guidance;
- use CARGA to break the law.
Subscriptions, through Apple
Subscriptions arrive at launch and are purchased through Apple’s App Store. The price and billing period are shown before you buy, and the subscription auto-renews until canceled in your Apple ID subscription settings. Billing and cancellation run entirely through Apple — CARGA never sees your payment details.
Refunds follow Apple’s refund process: request them from Apple. CARGA does not handle refunds beyond that process.
Intellectual property
The CARGA name, wordmark, the Tank, the app, and everything on carga.run belong to Brandon Alvarez, doing business as CARGA. These terms grant you the license in section 04 and nothing more.
Food descriptions you type or dictate stay yours. They are processed transiently and never kept on a server; the structured result lives on your phone.
No warranties
CARGA IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.
To the fullest extent the law allows, Brandon Alvarez, doing business as CARGA, disclaims all warranties, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that CARGA will be uninterrupted or error-free, or that its estimates fit your physiology on a given day. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
OUR TOTAL LIABILITY IS CAPPED AT THE GREATER OF US $100 OR WHAT YOU PAID IN THE PAST 12 MONTHS.
To the fullest extent the law allows, Brandon Alvarez, doing business as CARGA, is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for all claims arising out of or relating to CARGA is capped at the greater of one hundred U.S. dollars (US $100) or the amounts you paid for CARGA through the App Store in the twelve months before the claim arose. Where a limitation is not permitted, it does not apply to you.
Governing law
These terms are governed by the laws of New York, without regard to conflict-of-laws rules. Disputes belong to the state or federal courts located in New York, and both sides consent to that venue. If any part of these terms turns out to be unenforceable, the rest still stands.
Changes to these terms
We may update these terms. For material changes we post a plain notice on this page before they take effect, and the effective date above changes with them. Using CARGA after that date means you accept the updated terms.
